Public Comment Announcement for APA General Permit 2019G-1 Replacement of Certain Utility Poles


RAY BROOK, NY - The Adirondack Park Agency is accepting public comment on a proposed new general permit to expedite the review for utility pole replacements on certain lands inside the Adirondack Park. The new General Permit/Order - 2019G1 - would authorize replacement of certain utility poles on lands owned by or within rights-of-way held by utility companies or the New York State Department of Transportation.

Any proposal that meets the following criteria would be eligible for consideration pursuant to the new General Permit/Order:

a. The project will be undertaken by a regional or municipal utility company;

b. The project site is located on lands owned by or within a right-of-way held by a regional or municipal utility company or the New York State Department of Transportation;

c. The sole basis of Agency jurisdiction for the project is the replacement of utility poles involving: i) an increase in height and resulting in a final height above grade in excess of 40 feet; and/or ii) wetlands;

d. The project will not result in an increase in the number of utility poles; and

e. No proposed utility pole will increase by more than 25% in height above grade over the utility pole being replaced.

The General Permit/Order includes conditions that must be met related to conformance with applicable laws, regulations, safety requirements, and specifications; mitigation of impacts to wetlands; control of invasive species; and compliance.

The Agency will issue a signed certification approving the project within 10 business days of receipt of a complete application for proposals that meet the eligibility criteria and are in conformance with laws and regulations.
