RAY BROOK, NY - The Adirondack Park Agency (APA) will hold a legislative public hearing to solicit public comment on Velez Marine, LLC's variance application 2010-189. Velez Marine requests a variance from the shoreline restrictions of section 806 of the Adirondack Park Agency Act.
The project site is located on the shoreline of Lake Champlain along Valez Lane in the Village of Port Henry, Essex County on land classified under the Adirondack Park Agency Act as Hamlet.
The applicant proposes to reestablish and expand an existing marina. The following proposed activities and structures require variances pursuant to section 806 of the Adirondack Park Agency Act:
1) Filling and expanding 4 sunken barges to create expanded breakwaters;
2) Filling a marine railway to reestablish the natural shoreline;
3) Removing more than 30% of the trees six inches or more in diameter at breast height within 35 feet of the mean high water mark;
4) Replacing a preexisting shoreline retaining wall, with a new wall which is approximately 2 feet higher than the existing wall;
5) Installing a 16X 200 Wave Attenuator structure within the mean high water;
6) Replacing a preexisting 1,278 square foot single-lane boat ramp with a 1,758 square foot two-lane boat ramp;
7) Constructing an ADA compliant gangway which exceeds 100 square feet in size;
8) Constructing a gangway/stair structure larger than 100 square feet in (combined) size; and
9) Constructing a 12ft wide dock at the Hauling & Launching Area.
The proposed structures require a variance because they are greater than 100 square feet in size, do not comply with the definition of a dock, and/or are not a replacement in kind of the pre-existing structures on the site. The proposed removal of trees requires a variance because it exceeds the cutting allowed within 35 feet of the mean high-water mark under section 806.
The public hearing will commence on Tuesday, November 30, 2010 at 11:30 am at the Moriah Town Office, 38 Park Place, Port Henry, NY. Any person may speak during the public comment period of this hearing, and may submit written comments until the close of the public comment on December 2, 2010.
