RAY BROOK, NY - The Adirondack Park Agency (APA) is seeking public comment on its newest proposed general permit 2010-3; entitled "Change in Use of an Existing Commercial, Public/Semi-Public, or Industrial Building." The draft general permit would expedite APA approval for qualifying activities. It would apply when an existing building is proposed to be reused for a different defined use and the impact of the proposed change is minimal. The APA will accept public comments until August 2, 2010.
This general permit is issued pursuant to ยง809(13) of the Adirondack Park Agency Act(Executive Law Article 27) authorizing an expedited Agency review process for a project to change from a lawful use in an existing commercial, public/semi public, or industrial use building to a different use. Such change in use will not be material to the exterior of the building, its intensity of use and traffic pattern. There will also be no material change to the project site other than installation of new signage in full conformance with 9 NYCRR Appendix Q-3. Such change in use could include, but is not limited to, commercial retail to commercial office, commercial office to municipal office or not-for-profit organization office, industrial to office, public/semi building to commercial office, or public/semi public building to light industrial or artisan scale production. (The anticipated change in use will be limited to a commercial, public/semi-public or light/artisan industrial activity).
This action is a SEQRA, Type 1 action. A negative declaration and Full Environmental Assessment Form has been prepared by the APA and is on file at its offices in Ray Brook, New York. The proposed General Permit, application and certificate forms are available for review on the Agency's website at:
